Ana del Carmen López Ruiz holds a Bachelor’s degree in Biology with a specialization in Ecology from the University of the Americas–Puebla, Mexico. She is also a Regulated Canadian Immigration Consultant (RCIC #R712410), authorized to provide immigration advice and represent clients before Immigration, Refugees and Citizenship Canada (IRCC).

I do not recommend traveling outside Canada while waiting on a final decision for Permanent Residency. Cross borders are always a risk and you have to convince the officers about the reason for your entry to Canada. Please consider the fact that the CBSA officers have discretion in allowing travellers into the country.

Yes, a foreigner can incorporate a company in British Columbia and own 100% of the shares. There are no residency requirements for shareholders in a BC company, meaning non-Canadians can hold all the shares. 

If you had to renew your passport, you can extend your PGWP with your new passport only if

– You were eligible for a PGWP but

–  You didn’t get the full length because your passport was going to expire

No, your visitor visa application will not be processed until you provide your biometrics. Canada requires biometrics (fingerprints and photo) for most temporary resident applications, including visitor visas, and the application cannot proceed without them. 

In order to be considered in the CATEGORY BASED SELECTION – FRENCH you need to be eligible to ONE of the Express Entry Programs:

A “dummy” application in Canada refers to an application submitted by a main applicant to extend their stay, even when they do not fulfill all the requirements of the application itself.

These applications are often filed solely to “maintain status”, allowing the applicant to legally remain in Canada while awaiting a decision on their application, which can take months. 

But when these applications are detected by IRCC, the officers can immediately reject the applications and the applicants will lose status

Yes, you still need to provide proof of funds to cover living expenses for a year (minimum amount of C$20,635 CAD) in addition to your tuition fees, even with “maintained status”.

No, if you have been out of status in Canada for more than 90 days after losing your work permit, you cannot apply for a work permit by restoring your status. You would need to explore other options, such as applying for a Temporary Resident Permit or potentially permanent residence on humanitarian and compassionate grounds or spousal sponsorship in Canada class program.
